Eviction ban extended in England and Wales

The ban on bailiff-enforced evictions for private renters has been extended in England and Wales.

This will be until February 21 “at least” according to Housing Secretary Robert Jenrick; the ban will be reviewed at that date.

Landlords or agents acting on their behalf will still be able to enforce possession orders if tenants are more than six months in arrears irrespective of when the arrears accrued and therefore no longer have to pre-date Covid; however, these will go to court but cannot be enforced by bailiffs.

The exceptions to the ban still apply as before - in the relatively small number of cases of domestic violence and anti-social behaviour, for example, bailiff-enforced evictions can take place.

The government has also announced a further initiative for the private rental sector.

A statement from the Ministry of Housing, Communities and Local Government says: "A new mediation pilot will further support landlords and renters who face court procedures and potential eviction from next month (February). It will offer mediation as part of the possession process to try and help landlords and tenants to reach a mutual agreement and keep people in their homes.

"Helping to resolve disputes through mediation will enable courts to prioritise urgent cases, supporting landlords and tenants to resolve issues quickly without the need for a formal hearing. The mediation pilot will work within the existing court arrangements in England and Wales."

 

Anti-eviction campaigner Vicky Spratt took to Twitter almost immediately after the extension was announced to say the ‘bailiff-enforced’ element of the ban was “not enough” - she called for a ban on possession claims by landlords as well.

Scotland extended its ban yesterday to last until late March.

    Thanks another few months for our tenant not to pay rent. Thank you government for no help with this at all. Much appreciated. Understand we don’t want to make people homeless but also need to consider landlords who have not had months and months of NO rent. Thank you again for no support to landlords as a result of another knee jurk reaction to keep your votes up!!

    This stupid anti evictions campaigner, should re house tenants who don't pay their rent to how she like it. Tenant who involve in anti social & threatening behavior damaging landlords property, become abusive & do not pay their rent, have no place in our properties. We landlords are running our properties as businesses, not a charity.!! The government has not helped either, they're sitting on thir backsides, enjoying the lifestyle on their saleries. They have failed the Landlords disscracefully. This stupid shelter & other organisations are a serious threat to our businesses, & we landlords need to embrace our businesses properly & sadly to protect our business from these so called trouble makers. If they are so concerned then why don't they get togather and house these tenants for free rent, and then we will see how they turn, & finally see their reactions??

    I have a tiny portfolio of 1 property, which I bought due to a long underlying health condition, meaning I couldn't maintain a full time job. I'm shielding because of it. My tenant has been paying less than half the cost of the mortgage for almost the last year. This has crippled me. I've got the court order and even did the risk assessment, we were literally waiting for an eviction date. The worst part? The tenant wants to leave but if they go voluntarily they get put to the bottom of the list.
    I consider myself a level headed individual but this experience has taught me a lot and mark my words once this tenant leaves I will never rent to anyone who can't pay in 6 month upfront, I will never engage with requests from the council & you can be darn sure this government will not get my vote

    Omar, - Just be Very selective on your Tenant choice, Only accept those with a Guarantor, take out Rent Guarantee Insurance ( and keep my details ;-)

    And make sure the guarantor is a property owner who values a good credit rating. I have found such guarantors sort payment issues out pretty promptly but if it's just a pal acting as guarantor then you're no safer than no guarantor.

    The key to this is mitigating the risk, insist on a guarantor who is a home owner, earns good money and has a good credit rating,
    Let the council house the high risk tenants, and after this covid crisis and 6 month notice......there will be hundreds of thousands of tenants that fit the high risk category

    Rajeev cannot call for someone to be murdered and expect there to be no consequences. At best it is a malicious communication, at worst an incitement to murder. Some people here might find it funny, but I can assure you that saying that a journalist ought to be strung up is something the Police will take extremely seriously.

    John Smith, what exactly is your point, is he not allowed to express his views especially when he has been so heavily impacted on. Why would you need to forward his comments to anyone I am sure the Police & Council monitors this site already. Where the Landlord lives is irrelevant and if he lives in Harrow we might be a bit envious of him and if he has got a HM0' license he is already a victim, (a shame I used to like a pint of John smith's). Sorry the comments upset you but when we are being victimized unfortunately we feel the need sometimes to speak up.

    I like humour and we all need it. Truth of the matter here is that people from different perspectives will call for various things that there will be divergent ( strong ) views upon.
    The real numpties in all this are the Govt. because they don't have a plan and they're not helping anyone not Landlords Or Tenants.
    Yes it will take quite some time for landlords to get around to evicting the tenants that will be on the 'waiting list' - but then what - They will all hit Local Authorities who can't cope at the moment.
    Govt are just deferring a problem. ' kicking the can down the road '
    If they had come up with a Loan scheme for the genuine Covid affected 6 months ago, or really the same time as Furlough - then a lot of tenancies could be saved. For the Non-genuine, they should not have prevented Possession.

    I have read all your comments regarding me. Thankyou for your support to some who has defended my comments. I am a landlord just like any other landlord. I let my properties to tenants with rent gurantees, & guarantors, I make sure that I have these otherwise I don't rent to tenants If they don't pass their referances I don't take them. But I do take care of my tenants and oblige with my responsibilities for them. But when tenants become & commit anti social offences (as that now is an offence), become abusive, threatening, maliciously damage our fixtures & fittings, what are we to do. We call police for help as its going to escalate into crimal matters, but police say they can not do anything??. Its not that tenant has not paid rent, its the malicious damage he has caused to our property is the reason that I am evicting him. But I have to follow procedure just like anyone else to take him to court, spend thousands of pounds with a solicitor which very very is unfair. We all want tenants as its seem as they are our investments, we don't let to animals??, we let to humam beings . But it's very very unfair that when they become like above we are not given the protection that's needed to us landlord from police or the council.
    My comments to this lady who I now beliveis is a journalist, as I did not now before, may have been harsh, & I sincerely apologise for that. I was merely expressing that she is an anti aviction supporter , & her comments & requests what she is asking the government to do is uneceptable. Ifshe had these issueses with her tenants living in her properties, not paying their rent to her & damaging her property, would she support tenants like she doing now??, I guess not?!! We landlords are all terribly sufferering Finacialy, this is our business, we live from these investments, & because more rights are given to tenants, and landlords are left out . Not all my tenants are bad?! But there should be more protection given /provided to us landlords who are trying to survive in this paridemic with tenants who are not only not paying their /our rent, but also behaving very very badly in our properties with causing malious damage being done by them to our properties & to fixture & fittings , which is causing a great concern & financially some lanllords are suffering very very badly due to this by their tenants. What we landlords need is to get togather & support one another & form a support group, have someone take leadership for the group. Who can take us to the next level and forward us with these issues that we are having, to support, & have these issues with bad tenants solved, get more rights for us landllords, to curb these issueses.

    Further to that, and expanding on my opening comment, when Covid is out of the way, so many areas of life will be a mess and require Govt. focus. We will have the ban extended yet again, as the ‘easy’ option, until they have the time/will to deal with the problem that will continue to mount, making dealing with it ever more difficult.

    But at some point, maybe in a years time, they will be evicted, I would hope that for the sake of around just £60 that any landlord with a tenant like this will issue a money claim online, then these '' basterds'' will have get a CCJ flag up every time that they are checked out for the next 6 yrs, and we will all know not to touch them with a barge pole.

    I'm not a member of the NRLA and have no intention of joining, they seem like a total waste of time, I am however a member of Eastern Landlords Assoc since the early 90s , okay they don't have much clout against government, but they are never more than a phone call away and very helpful, we need something powerful to represent us, but what and who ?

    In the space of 10 months it has been normalised to shut down businesses on a whim, enforce lockdowns & curfews, to ban criticism of all government policy & to ban the US President from all social media platforms. This is hardly what you would call normal behaviour, but there seems to be plenty of people out there especially on the left that seem to think all this is perfectly acceptable..

    In answer to Lia Jordan about what next, it’ll take a little more time, but I believe that guarantors will become part of a a ban. I’ve been taking them since 2007 and they’ve worked wonders, but as almost all tenants, at least where I live/operate (I have volume), end up owing rents arrears or damages, the guarantor ends up paying…because I’ve mastered the Courts. They then don’t want to guarantor for them again and eventually these tenants will have no choice but to become the LAs problem. Then you have the likes of the TDS deposit scheme pushing for an in-house, mandatory, binding conciliation service (which also comes with an imbalance that if the LL breaks the terms is prevented from evicting for SIX MONTHS, but if the tenant breaks the terms then the LL is ‘awarded’ a ‘fast-track’ through the Courts…hmm), when LLs get their fingers burned and virtually everyone has switched over to the guarantor model, the TDS will play up that their new revenue stream has gone, the Govt. won’t like the idea we’ve ‘gotten around’ them being the adjudicators on every single matter (they’re hardly going to side with LLs when that means the tenant becomes their problem) and so will take tenancies outside of normal contract law…it’s not like the housing industry doesn’t already fall outside other norms such as tax with S.24…!

    I agree guarantors work very well actually as it stops the problem from happening to begin with. It focuses the tenant in a way we can’t and Shelter, TDS and other parasite organisations will campaign to make illegal

    Please calm down guys, for a moment, hard as it is when the flipping bent prats in Parliament, Councils and other govt employment, > the lot who tell us how we should do things and get paid an awful lot of money for their massive incompetence and not unknown devious conduct.
    Here is an idea for those brainless dimwits. Now that due to home working many companies and some govt. depts. will be able to release significant amount of buildings, which can be converted to housing. These brain dead lot can take their favourite tenants,>unable/unwilling to pay rent and put them in those buildings and feed them, instead of screwing the private landlords!
    I write this with an apology to a very small proportion of fair minded, genuinely concerned and committed public sector employees and parliamentarians > I would say this may be around 5 to 10%. Oh and one final point govt. talks a lot about free market enterprise and load of bull, but remember they are there to protect their buddies irrespective of whether they are blue red or yellow (Con, Lab, Lib). Remember what they did with Fred the Shred when he collapsed the UK Banking System within days of the Northern Rock Crash. NOTHING , well took his (k)nighthood and made him see Daylight?

    Are we likely to get a possession order through at the moment? Is the ban only on bailiffs? Paid a company £1200 to send section 21 to court seems like I might as well have kept my money
