You're right about claiming for major claims only, Andrew. It's not worth claiming for smaller issues as it increases your premiums, even if it's not your fault. Our upstairs neighbour caused 6 leaks from their bathroom in the last 15 years. The Owner lives in Australia and they don't respond to calls nor emails from me. Their Agent who manages their flat is also useless. Normally we repair our ceiling and walls ourselves, so as not to make an insurance claim. The upstairs tenants are lovely people and helpful too, unlike their LL. They arrange to get the leaking pipe or whatever it is, repaired asap. However, this time, the leak was quite big, and I was fed-up with this constant leaking from their flat. So I told their Agent that they should arrange to do the repairs and refurbishment to my kitchen and bathroom at their expense. Long story short...... After a year of going back and forth (and my tenant, bless him, has a lot of patience living in that condition) it was pushed back to me saying that I should claim from my insurance for the repairs to the damage caused by their leak. They said they're not liable to repair the damage to my flat. My insurance company (RentGuard) said the onus is on me to have my flat refurbished and make a claim. All I needed was a letter from the upstairs Agent or LL confirming that the repairs to the leak were done and the leak stopped. Needless to say, we did the repairs ourselves, again. But I am very furious.....!! (Apparently this is law in England?)

Absolutely right, Michael, here I am.... Shame that there isn't an organisation standing up for our rights and arranging a YouGov poll of 3,500 LL revealing the most common illegal act caused by tenants! That would be interesting, but not surprising. Tenants in one of my properties are moving out on the 1st Oct. They've blocked me on their WhatsApp and eMail, LOL. They're cross with me because I've been contacting them daily for the rent arrears for Feb & Mar 2021. And because I'm chasing them for rent for this month, which was due on the 1st; today is the 14th. They were planning on using their Deposit to pay for their last month's rent. They're cross because I told them they have to professionally clean the flat (which is the way they received it 2 years ago), and on inspection a week ago, it was so disgustingly dirty that I wouldn't put my dog to live in there. They're also cross because they find it an imposition that I have arranged for a 3rd party company to do the Inventory and Check-out on the day they move. It's all a bloody joke. But thank goodness they have a Guarantor, so my threaten of a CCJ made them pay up very quickly! I phoned the NRLA Advice line about the professional cleaning, and they advised me that the tenants aren't obliged to have the Flat "professionally" cleaned as from June 2019 (I think?) because that's when the Tenants Fees Act came in. The 3rd party company doing the check-out is OK, because I'm paying for it, but I have to be present while the check is being done. All I can say is thank God I did the Check-in and am going to do the Check-out (with the same company). That report will produce all the sh*t they've caused; they can kiss their Deposit good-bye!

Hello Paul, Don't worry, I'll explain why below, so that you don't have to be surprised anymore.... But before I do, I don't care if you think I'm not a proper Landlord. All my tenants think I'm OK, and that's all that matters. They're the ones paying me, not you, so you carry on thinking I'm not proper, it makes no difference to me. At least I'm still in business, and you're the one that's leaving the PRS. Another thing I want to ask is... who are you, Paul? Your profile doesn't state anything about you? and there's nothing listed in the "My expertise in the industry" section? How can we take what you say seriously when we don't know who you are? Have you seen my profile? At least you know who you're talking to here. So now that we've established that we know nothing about you, we can move on. (You may be one of those "feckless" tenants pretending to be a Landlord for all we know). What I don't like about some of the things you say is that there doesn't seem to be any comradery coming from you. Us LL should stand together against this sh*ty system, but yet you come along and pull us down. Comments like the following:- "Fools rushing in are what new entrant LL are" - dated 13/2/20 "Good being a LL, isn't it?" - response to MJ Evans 18/3/20 "Mass bankruptcy of many mortgaged LL" - and other awful comments dated 28/3/20 "Best you get a job then. Lots of field workers required". - response to Heather Keenan 28/3/20 "Country going to the dogs. Best get out of the PRS asap". dated 31/3/20 "Twits like Martha." - dated 2/4/20 The way you treated Martha Vest was despicable, Paul. Myself, Michael Foley, Martin Hucker and others thought you went too far. You were too severe and downright nasty. In fact, you inspired some person called "Your time is coming Paul Barrett" to go against your horribleness. (I don't agree with coming on here without a proper name, by the way. And you can see my comments to that person dated the 19/3/20). And then you've got the nerve to state "Even on here a site for LL we have some idiot LL castigating other LL for wishing to behave in a business like fashion". dated 2/4/20 LOL..!! you're probably talking about me. Can't you see, Paul, that YOU'RE the idiot LL castigating other LL on this site? Wait, I'm not quite finished yet..... What about the complementary comments you say about tenants.... "Homeless scum" - dated 9/2/20 "Scroat of a tenant" - dated 28/3/20 "Students are feckless snowflake wasters and not worth bothering with" - dated 2/4/20 "The feckless attitudes of students makes them unsuitable tenants as far as I'm concerned" - dated 2/4/20 Imagine the LL on here (and there are some, I've noticed) who's children are students. How would they feel with comments like these? Paul, I'm also pi**ed off with the system. Disappointed and feel let down. Feel betrayed and very, very annoyed. But I don't take it out on other LL on here, and especially not on tenants (students or other) who pay me my bread and butter every month. Pull yourself together Paul, otherwise leave this site. Hi Faris, please go to the NLRA website (NLRA.org.uk) and all your questions will be answered. Also, (if you don't already do so), listen to LBC radio and read the news on their website - this is updated daily / hourly. Clive Bull (LBC) had a property specialist on his talk show this evening, and he confirmed everything which you will read on the NLRA website. So basically, I'll try and answer as best I can. As a LL you are expected to give your tenants a 3 month rent holiday if they ask (as per the latest government announcement). And you, in tern, will be allowed to take a 3 months mortgage holiday. If your tenant's father is her guarantor, then I expect you to have a Tenancy Agreement signed by him? In that case, yes, you have a legal right to ask him to pay the rent, but as mentioned above, our government has given our tenants permission to have a rent holiday, so unfortunately he is allowed to decline to pay you for the next 3 months. As far as I understand, tenants don't have to produce any proof that they can't pay your rent. If they tell you they won't pay you, you are obliged to give them a 1 to 3 month rent holiday this government said they're allowed to have. A discount of 20%? At the end of the day, they are staying in your property and have to pay you your rent - if you'd like to be helpful and kind, then of course, give them a discount. However, don't get caught in a situation where you give them a 20% discount (to entice them to pay your rent), but then they realise that they have permission to take up to 3 months rent holiday. At the end of the 3 months, Faris, you will still need to get your rent from them, as this is just a rent holiday, not a 3 month rent discount. (And it works the same for a 3 month mortgage holiday - at the end of the 3 months, you'll still need to pay for the previous 3 months). I hope this helps.
