Completely agree Nick! I am in the process of serving a Section 8 for non payment of two months rent. My tenant is claiming he is poorly, but his social media contradicts that as he is publicly posting on a daily basis posts of himself abroad partying every night - for the last couple of months! Meanwhile I am £5k down in rent, have a mortgage to pay, and now legal/court fees, and I will assume will incur even further expenses for upcoming bailiff costs to have him evicted. Not forgetting the void period and refurb costs to reinstate the house back to a rentable state. The whole process will more than likely exceed 6 months with the back log at court. Where is the protection for the landlords against tenants abusing the system like this? Admittedly there are rogue landlords out there, but equally there are also “rogue” tenants, and therefore both sides should be protected. Landlords are running a business, and like any other business require a profit to survive. Why are other businesses allowed to make a gain, yet landlords renting their properties are not? Why are all tenants being treated as the “victims” and now been given free legal aid! Renting is a business - Not a charity! The in just of it all is so very infuriating!!!

Sandra We landlords are “whining” as many unfair restrictions and new legalisations have been imposed on us PRS landlords. When I bought my properties some years ago none of these new tax laws/legislations were on the horizon.Therefore unfortunately for some landlords under these unexpected and unforeseen circumstances they simply cannot afford to “step up!”

My thoughts exactly! Why is the focus purely on Landlords there are equally as many unscrupulous Tenants! And Politicians as for that matter. If there are rents rising, well that’s down to all the new legislations imposed on Landlords that have caused them to either sell or put up their rents to survive! Where is the Landlords protection?

They’ve been chipping away for some while now. If the Labour government get in at the next election, there really won’t be much point staying in the PRS and for the middle class and wealthy people- watch out!

It’s not a long term solution for landlords switching over to Airbnbs it won’t be long before the government start imposing the same or worse regulations as the PRS. And if a labour government get into power we may as well all sell up in the UK and with whatever we are left with after paying the astronomical CGT ..perhaps consider reinvesting overseas in places such as Florida.

What a nightmare that must’ve been Michael! I had a tenant that took it upon himself to build an enormous concrete patio in the front garden to accommodate his dog kennel, which was all done without my prior knowledge or permission.

Does anyone have any what happens with old purpose built flats that probably do not have much hope of reaching an EPC rating of C because of the way they were originally built. As a leaseholder I can only upgrade internally..so does that mean the freeholder will be obligated to upgrade externally?

On a positive note can you imagine how much worse it would’ve been for us landlords if a labour government (namely Jeremy Corbyn) made it as PM. There may be some miraculous turnaround with the new PM?. I’m not giving up all hope just yet, but will have a plan B in place for “worse case scenario”.

I’ve been thinking exactly the same thing for years Paul. The Government mislead the public by giving the impression that all landlords are “crooks” with far too much money, and it’s their job to strip it all away from us.

My mortgage broker has told me the same thing. I also have friends that don’t seem bothered by all of this and are continuing with purchasing more properties for BTL purposes and do not have any intentions of selling any of them. I can only assume it’s because they are very well off and are not bothered by all of this.

Some years ago I thought it would be a good option to handover a couple of my properties directly to Haringey Council on a 3 year tenancy agreement. At some point during the tenancy I had discovered that the properties were left to deteriorate, they were disgusting! Based on that I had decided not renew the tenancy agreement, and so prior to the tenancy agreement coming to an end I had given the required notice requesting the return of my properties with vacant possession. On the “moving out date” they did not relocate their tenants. Haringey councils excuse was that “they needed more time” as they had a shortage of properties and could not relocate their tenants. I was sympathetic for a while ..but It reached a point whereby it became apparent that Haringey council had no intentions of moving their tenants out, which resulted in me having no choice but to take legal action. Shockingly a few days before the court case I had received a call from the director of housing (at Haringey council) trying to persuade me to drop the case. His tactics did not work. At the court hearing the judge gave the council an eviction date, and ordered to pay all of my legal fees and compensation for the deterioration of my properties so I could then renovate them back to their original condition (less any wear & tear). Where do you think the council found the money to compensate me? From when I had started the process it had taken almost two years to evict the council from my properties. I had never expected anything like that from a council, it was one of my worse rental experiences. Would I ever rent to the council again? ABSOLUTELY NOT!

It’s these type of rogue LL’s that give us decent, LL’s a bad reputation!! The rogue LL’s should be the ones to be penalised and ordered to pay the excessive fees to the council to obtain a LL’s license. As for the professional LL it should be FOC!

Yonette - Has it occurred to you why nobody has liked your post? Perhaps it has something to do with your comment that P.LLS are “money grabbing” and that rents should be capped! The Councils new demands for P.LLS to license their BTL is “most definitely a money making scheme!.” Professional LLS do not have an issue with obtaining a LL license, they are simply infuriated with the unjustifiable huge costs involved in doing so. It is ignorant to suggest Investing in properties makes P.LLS “money grabbers!” You clearly are not a LL yourself as you do not understand the costs involved in having a BTL. This forum is called “Landlord Today”, and as you have such a grim view of P.LLS perhaps you should go on a different forum whereby your comments would be welcomed elsewhere - as they certainly are not here!!

Airbnb have an optional reviews system and a star rating from 1-5 in place whereby guests & hosts can write a review after checkout. It would be (fair) and helpful for the decent LLs and tenants to have this type of site available to us.

The Borough that I let my properties in require LL licensing, it’s £600 per property, pr annum with a £30k fine per property if not done - I don’t see an issue with obtaining a license, but why should the fee be so high ..if at all - and why are only some boroughs making it a legal requirement and other boroughs are not?

I agree with all the comments made. It’s been some years now that I have not increased my tenants rents to the market (rental) value, but the way things are going with all the Governments constant new regulations I will soon have no choice but to do so. Perhaps we should be exploring the possibility of selling up and investing abroad - but there still is that hefty CGT to consider. .

Good idea from Barclays, however I do not think they seem to realise that it is not enough incentive for private landlords to invest nowadays, especially with the new tax system in place.

Clearly this has not been reported in full. Why are landlords not protected from “rogue” tenants? Why does the law favour the tenants? There are genuine landlords and tenants, but there are also disingenuous landlords and tenants that abuse the system. Perhaps if the law was fairly balanced to cover both the landlords and tenants then incidents like this could be prevented. .

Would strongly recommend you to speak with a specialist tax accountant that can advise you the best way forward, as in some cases it is not worth transferring your personal properties into a company due to the cost implications and returns.

Elizabeth, totally agree with you and Saul Smart and some of the other comments posted. When the introduction of the increase of tax was phased in between 2015-2021, “Only for the Private Landlords” many took to off loading properties as it became unaffordable for them to retain them. Why have commercial landlords have not been targeted as heavily? Why did the Government scrap section 21? Why is the Government imposing new restrictions at every angle to apply pressure ONLY to the private landlord? They clearly are trying to get rid of the private landlords!!

In all the years of being a landlady I have found the government/councils to ONLY have changed regulations to support the rights of the tenants. It appears that all landlords have simply been tarnished with the same brush as “wealthy rogues landlords”, and so many tenants have used this to their advantage and manipulated the system in their favour to get away with defaulting on rent and destroying properties- all at the expense of the landlords. Not all landlords are rogues - some of us are sincere hardworking individuals and we require new government/council regulations to protect us from being taken for granted by some these tenants that abuse the system!

I’ve personally suffered financially from Tenants abusing the system - the law favours Tenants and it is unfair that these Tenants are able to abuse the system and get away with it!!

I appreciate that there are some genuine cases of renters not being able to pay their rent, equally there are also a lot of Tenants that abuse the system and because of the way the Tenant/Landlord Laws are which is mainly in favour of the Tenant they are allowed to get away with it usually by owing thousands of pounds in unpaid rent and legal fees. As a private landlord I have personal experience of this and find it absolutely infuriating that it is the majority of Tenants beliefs that Landlords must accommodate them if they cannot or will not pay the rent ..regardless of the fact that we too have mortgages and expenses to fund., and having a sitting Tenant would financially cripple some Landlords with mortgage arrears and the threats of repossession and being black listed for years!! The message I’d like to give to Tenants is especially to the ones that taking advantage of the system - It is unfair to expect and put a Landlord through this hardship - who looks out for the landlord??
