Just coming up to 50 years experience in residential and commercial conveyancing in private practice and local government. Became a Licensed Conveyancer in 1989 and appointed Head of Property Department at Morecrofts Solicitors in April 2016.

This has always been a problem with benefit tenants. However surely this is a trespass matter. The previous tenancy has been brought to an end no further tenancy created. Therefore the Section 8 and Section 21 notices may be ineffective as the tenancy they are purported to be served on no longer exists.

This scheme has been in place in Liverpool for a few years and has begun to weed out rogue landlords. Those who have been taken to court have faced severe fines. Therefore in the long run it can only be a good thing. On a side issue, where such a scheme is implemented a landlord cannot serve a notice terminating an assured shorthold tenancy if he has not registered with the Council.

I wonder how may of the councillors who voted against implementing the scheme are landlords? That might be a starting point for the task force
