Is that all! He should have had a suspended sentence and community service at the very least. The tenant should also pursue a civil claim for damages. It makes a mockery of landlords who follow the due process

Hi Peter, For help at a local level you can email mike.pollard@ewemove.com To be clear, we are sales and letting agents in Cambridge, but he'll be happy to give advice and assistance free without any obligation. We've got LOTS of experience in dealing with crisis management situations. It can be incredibly stressful for a landlord and deeply unsettling for a tenant. Lets play out the economics on this; 1) Landlords will sell off stock, reducing house prices in the short term 2) New landlords will be discouraged from buying 3) Limited supply of rental houses will mean that supply/demand will push up rents 4) This 'tax' is a tax on tenants who'll ultimately end up paying more (Sshhh - keep it quiet. George has sold this to the public that only landlord's will be effected. Once the tenants feel this, in a few years time, he'll probably be out of his job)

Not wanting to dampen the mood, but the ramifications for the whole lettings industry could be seismic. Under contract and tort laws, agencies have duty to act in the best interests of client's, and it is long been established in the legal world, that you cannot act if their is a conflict of interest, unless this is disclosed and accepted. Taking fees which are not contracted, and not disclosing 'hidden' fees (kickbacks), or whatever term you'd like to call them puts a Letting Agency on a very dodgy footing. If this case goes against Foxtons, it could open up an industry'PPI' type claim scenario against all letting agents that practice this. Claims will be able to go back 6 years.... Given my legal background, this is one reason why we've never adopted this particular practice. Maybe this is a tad over dramatic, time will tell.
