Very often the tenant doesn't want to be at the check-out, after all the rest of their lives lies elsewhere. But from the agent viewpoint they should always try to have a tenant present. Otherwise any subsequent claim is automatically prejudiced. All Schemes have said this.

Just because the tenancy is not an AST doesn't mean you don't need a Court Order. Unless these measures will sweep away an occupiers rights under PFE Act 1977

Why would there be any issue of opening drawers that are empty? TDS has openly said with no check-out form signed by a tenant the Landlord's chances of succeeding with proposed deductions the tenant has not at least been made aware of, reduce dramatically

Yup - property forfeiture is the only penalty for serial offenders who otherwise stay ahead of the game they are playing.

Until properties are taken off Landlords like this, forfeited, nothing will change. This site has been featuring stories like this for several years, and will for the next 20 years unless and until serious penalties are available AND enforced. End of, otherwise do not bleat.

Only two reasons it happens - Landlords and agents being too keen to take rent up front, especially 12 months worth, plus then Landlords not inspecting self-managed properties and agents not inspecting managed ones. One tip if you get one of these. Police will often change locks themselves, or request you to do so. Either way it is unlawful exclusion without a Court Order or an agreed surrender with the tenant (unlikely as they will have scarpered!)
